On February 23, the High Court issued an order in response to a petition filed by the mother of a victimized child, who claimed that despite the two doctors′ claims to be specialists and superspecialists, they lack the necessary credentials. According to the petitioner, her son, Master. Devarsh Jain was rendered permanently bedridden as a result of their ′negligence.′

The Intensive Care Unit (ICU) for critically ill newborn babies at Fortis Hospital, Shalimar Bagh, is run by Dr. Vivek Jain and Dr. Akhilesh Singh.

According to the Delhi Medical Commission, which had cleared the facility, no medical malpractice could be attributed on the part of the doctors at Fortis Hospital, Shalimar Bagh, New Delhi, in the treatment of the complainant′s child. The hospital is also defending the doctors, stating that all of their documents are accurate.

On the other hand, the attorneys of the victim, Mr. Sachin Jain, and Mr. Ajay Kumar Agarwal, have claimed in their application to the court that Fortis Hospital appointed Dr. Jain as Director and HOD of Neonatology and that he is currently practicing as a super-specialist neonatologist for treating newborns in intensive care units, which is against the law.

In her application, Mrs. Sapna Jain claimed that the other physician, Akhilesh Singh, was also working at the hospital as a senior consultant in neonatology, pediatrics, and neonatology, caring for severely ill newborn babies in the Neonatal ICU. She claimed in a plea she had submitted to the Delhi High Court in 2019 that the hospital had treated her child for 12 days in the intensive care unit before releasing him on the false assumption that he was healthy.
